Terms of Use

These Terms of Use ("Terms") govern your use of the Magestican Studios website at magesticanstudios.com.au (the "Site") and the games we publish (the "Games"). The Site and the Games are operated by Ultra Task Pty Ltd (ACN [to be inserted]), an Australian proprietary limited company, trading as Magestican Studios ("we", "our", "us").
1. Acceptance
By using the Site or a Game you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or Games.
2. Licence to use the Site
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for personal, non-commercial purposes. The Site's source code is published at github.com/magestican/arbelo-games under the MIT Licence — that licence governs re-use of the code itself.
3. Licence to play the Games
Each Game is distributed under a licence that will appear at the point of download or purchase (for example, on the itch.io or Steam store page). Where a Game's source code is published in the workshop repository, that source is available under the MIT Licence; game-specific art, sound, music, and story content is not automatically covered by that MIT Licence and remains the property of Ultra Task Pty Ltd or its licensors.
4. Intellectual property
All content on the Site and in the Games — including the "Magestican Studios" name and logo, game titles, characters, story text, art, music, and sound design — is owned by or licensed to Ultra Task Pty Ltd, and is protected by Australian and international copyright and trademark law. Nothing in these Terms grants you any right, title, or interest in any of that material other than the limited licences described above.
5. Your content
The Site does not accept user-generated content. Any correspondence you send us (email, bug reports) may be used internally to improve the Site or the Games, and may be quoted in aggregate (anonymised) in change logs, but will not be published verbatim with your name attached without your permission.
6. Fitness and warranty disclaimer
The Site and the Games are provided "as is" and "as available", without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability. We do not warrant that the Site or Games will be uninterrupted, timely, secure, or error-free, or that any content will be free of viruses or other harmful components.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.
7. Limitation of liability
To the maximum extent permitted by law, Ultra Task Pty Ltd and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or exemplary damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of the Site or Games, even if we have been advised of the possibility of such damages. In any event, our total liability arising out of or in connection with these Terms will not exceed the amount you paid us (if any) for the Site or the Game in the twelve months before the claim arose.
8. Third-party links and services
The Site may link to third-party websites (for example, storefronts hosting our Games). Those sites operate under their own terms and privacy policies. We are not responsible for their content or practices.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged on the Site's home page for a reasonable period. The "Last updated" date at the top of this page indicates when the current version took effect.
10. Governing law
These Terms are governed by the laws of the State of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia in respect of any dispute arising out of or in connection with the Site, the Games, or these Terms.
