Terms of Use

These Terms of Use ("Terms") govern your use of the Magestican Studios website at magesticanstudios.com (the "Site"), the games we publish (the "Games"), and our applications distributed through the Apple App Store (the "Apps"). The Site, the Games and the Apps are operated by Ultra Task Pty Ltd, an Australian proprietary limited company, trading as Magestican Studios ("we", "our", "us"). ABN 93 700 712 910, ACN 700 712 910, Gold Coast, Queensland 4226, Australia.
If you are here about one of our iOS apps, the licence that governs it is Appendix A — End User Licence Agreement at the foot of this page.
1. Acceptance
By using the Site or a Game you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or Games.
2. Licence to use the Site
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for personal, non-commercial purposes. The game code this Site serves to your browser is offered under the MIT Licence — see our licence page for the full text and for what it does not cover.
3. Licence to play the Games
Each Game is distributed under a licence that will appear at the point of download or purchase (for example, on the itch.io or Steam store page). Where a Game's source code is published in the workshop repository, that source is available under the MIT Licence; game-specific art, sound, music, and story content is not automatically covered by that MIT Licence and remains the property of Ultra Task Pty Ltd or its licensors.
4. Intellectual property
All content on the Site and in the Games — including the "Magestican Studios" name and logo, game titles, characters, story text, art, music, and sound design — is owned by or licensed to Ultra Task Pty Ltd, and is protected by Australian and international copyright and trademark law. Nothing in these Terms grants you any right, title, or interest in any of that material other than the limited licences described above.
5. Your content
The Site does not accept user-generated content. Any correspondence you send us (email, bug reports) may be used internally to improve the Site or the Games, and may be quoted in aggregate (anonymised) in change logs, but will not be published verbatim with your name attached without your permission.
6. Fitness and warranty disclaimer
The Site and the Games are provided "as is" and "as available", without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability. We do not warrant that the Site or Games will be uninterrupted, timely, secure, or error-free, or that any content will be free of viruses or other harmful components.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.
7. Limitation of liability
To the maximum extent permitted by law, Ultra Task Pty Ltd and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or exemplary damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of the Site or Games, even if we have been advised of the possibility of such damages. In any event, our total liability arising out of or in connection with these Terms will not exceed the amount you paid us (if any) for the Site or the Game in the twelve months before the claim arose.
8. Third-party links and services
The Site may link to third-party websites (for example, storefronts hosting our Games). Those sites operate under their own terms and privacy policies. We are not responsible for their content or practices.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged on the Site's home page for a reasonable period. The "Last updated" date at the top of this page indicates when the current version took effect.
10. Governing law
These Terms are governed by the laws of the State of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia in respect of any dispute arising out of or in connection with the Site, the Games, the Apps, or these Terms.

Appendix A — End User Licence Agreement for our apps
This Appendix is the End User Licence Agreement (the "EULA") for the Magestican Studios applications distributed through the Apple App Store — currently Multi Game Madness and Multi Game Madness After Dark (each an "App"). It applies in addition to the Terms above. Where this Appendix and the Terms above differ, this Appendix governs your use of an App.
A1. This agreement is with us, not with Apple
This EULA is concluded between you and Ultra Task Pty Ltd only, and not with Apple Inc. We, and not Apple, are solely responsible for the App and its content. This EULA does not provide usage rules for the App that conflict with the Apple Media Services Terms and Conditions.
A2. Scope of the licence
We grant you a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. You may not rent, lease, lend, sell, redistribute or sublicense the App.
A3. Maintenance and support
We are solely responsible for providing any maintenance and support for the App. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services for the App. Support requests go to support@ultratask.com.au, or through "Report a problem" in the App's About screen, which pre-fills the version information we need.
A4. Warranty
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (the Apps are currently free, so that refund may be nil). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
Nothing in this EULA excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
A5. Product claims
You and we acknowledge that we, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. This EULA does not limit our liability to you beyond what is permitted by applicable law.
A6. Intellectual property rights
If a third party claims that the App, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
A7. Legal compliance
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Email is the contact route for the Apps. Apple's minimum EULA terms also contemplate a telephone number; we publish a monitored business email instead, and will answer any question, complaint or claim about an App through it.
A9. Third-party terms
You must comply with any applicable third-party terms when using the App. In particular, the Apps' online multiplayer connects players directly to one another over the internet using a public signalling service; using that feature over a mobile network is subject to your carrier's data agreement, and any data charges are yours.
A10. Apple is a third-party beneficiary
You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that on your acceptance of this EULA Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
A11. Game updates delivered outside the App Store
Every game is built into the App, so the App works with no network connection. The App also checks magesticanstudios.com on launch and downloads updated versions of those same games — our own HTML5 and JavaScript — so that a fix reaches you without waiting for an App Store update. By using the App you consent to those updates being downloaded and applied.
Updates are verified against a published SHA-256 hash before they are used, are confined to the games' own files, and never replace the App itself. The version built into the App always remains as a fallback. Updates over a mobile network may incur data charges from your carrier; updates larger than 8 MB wait for Wi-Fi unless you ask for them sooner.
A12. Acceptable use
You must not use an App to harass, abuse or harm another person, to attempt to gain unauthorised access to any system, to reverse engineer the App except to the extent that restriction is prohibited by law, or in breach of any applicable law. Online play is peer-to-peer and unmoderated by us in real time; if another player behaves unacceptably, stop playing with them and report it to support@ultratask.com.au.
A13. Age restriction
Multi Game Madness After Dark contains survival horror and first-person shooter content and is rated 17+. You must not use it if you are under 17. The App asks you to confirm your age before any content rated above the App's own rating will open; confirming an age you do not have is a breach of this EULA.
A14. Termination
This EULA is effective until terminated. Your rights under it terminate automatically, without notice, if you fail to comply with any of its terms. On termination you must stop all use of the App and delete it. Sections A4 to A7, A10 and this section survive termination.
